General Terms and Conditions:
Validity :
The choice of goods contained in our Internet site shall be subject to change without notice. All prices given shall become invalid with the publication of a new offer. The validity of the prices offered shall refer only to the stock present at that time. All orders require written confirmation.
Prices:
All prices are per bottle inclusive of sales tax (the statutory value added tax (19%) rsp. Differenzbesteuerung nach §25a UStG).
Delivery condition:
The supply exclusively takes places against pre-payment or against cash and carry payment.
Reservation of ownership:
The delivered goods remain our property until complete payment has been made. This also applies regarding resale to third parties.
Shipping costs:
For German orders above 1000 Euro there is no delivery charge. Under 1000 Euro we charge postage of 8 Euro for a normal delivery and 20 Euro for an Express delivery. For shipping to abroad in each case remaining costs will be charged individually.
Place of fulfilment, passage of risk, shipment:
Our registered office shall be the place of fulfilment. We shall ship the goods at the purchaser’s risk from our warehouse to the shipping point desired by the purchaser. If no other address is given, the shipment shall be made to the invoice address. If the shipment is sent by post, the General Terms and Conditions (Allgemeinen Geschäftsbedingungen - AGB) of Deutsche Post AG shall apply in addition to our own. Likewise, in the case of shipment by forwarding agent, the General German Forwarder Conditions (Allgemeine deutsche Spediteur-Bedingungen - AdSP) shall apply.
Complaints:
The purchaser is to investigate the goods immediately upon delivery to ascertain whether there is any shortfall or whether any damage, in particular breakage, has occurred during transportation, and to have any shortfall or damage receipted on the consignment note, separated according to types, in order to be able to put forward the corresponding claims against the forwarder. In case of delivery through DHL or other services any shortfall or damage has also to be receipted through the forwarder immediately upon delivery . Optical defects regarding the condition of the bottles shall not entitle the purchaser to make a complaint; this shall apply in particular to the condition of the label, of the capsule and to the fill level in the bottle. Should the purchaser wish, we shall be pleased to inform the purchaser, prior to commissioning and shipment, about the exact condition of the bottles or can send via E-Mail.
Warranties / cork:
According to common practice in the industry, no warranty shall be assumed for wines with cork problems, as cork faults constitute an unavoidable risk for which the producers also do not assume any warrantee.
Place of jurisdiction:
The competent local court in Wittlich shall be the place of jurisdiction. However, we shall be entitled to take legal proceedings against the purchaser before the court competent for the purchaser.
