General Terms and Conditions for our Textile Products
§1. Offer and Conclusion of Contract
1.1 Contact via Internet
By ordering goods on our website the customer places a firm order which leads to the conclusion of a sales contract.
1.2 Orders in writing or by telephone contact outside of our Internet shop:
Unfortunately we cannot accept either written or telephone orders.
1.3 We accept the order and deliver the goods within 21 days.
1.4 We reserve the right to refuse the order.
1.5 We reserve the right to change at any time the offer, the composition of the goods, the price, the availability and the delivery time. Errors are excepted.
§2. Prices and Terms of Payment
2.1 Domestic: Please transfer the total amount stated in the invoice to the bank account which is given within 14 days. The goods remain our property until complete payment has been received.
2.2 International: Our overseas customers have the possibility of paying by PayPal or by bank or postal transfer (SEPA). We accept only pre-paid foreign orders.
2.3 All prices quoted are end-user prices in Euros.
2.4 The customer has a right to set-off/accumulation only if his counterclaims are valid or indisputable. The customer is only entitled to exercise his right of retention in so far as his counterclaim refers to the same contractual relationship.
2.5 In the event of payment default, a collection fee/processing charge will be levied.
2.6 Interest on arrears will be charged without prior notice after the second reminder. Interest on arrears will be calculated at the rate of 5% above the basic lending rate p.a.
2.7 Deduction of discount is only possible after special written agreement.
§3. Shipping
3.1 Within Germany delivery is by UPS. Every shipment is insured.
3.2 For overseas shipping costs please see the invoice sent to you by e-mail.
3.3 Shipping costs are always charged to the purchaser.
3.4 Goods are always shipped on Mondays, Tuesdays and Wednesdays.
§4. Minimum Value of Order
4.1 We do not ask for a minimum value of your order.
§5. Delivery Time
5.1 We like to keep delivery times to a minimum; nevertheless, delivery times of up to 21 days are possible as our goods are handmade. We ask for your understanding.
§6. Weight of Goods
6.1 The weight of the individual skeins can vary by +/- 10%. Wool is a natural product and the weight may vary according to the moisture content of the air.
§7. Right to Revoke, Right to Return
7.1 The goods may be returned anytime within 30 days of receipt (date as postmark) without giving reasons for return. The costs for returning the goods will be borne by the customer up to a merchandise value of 40 EUR. The customer carries the risk for the return of the goods.
7.2 Goods valued at over 40 EUR can be returned as a parcel. In this case also, the risk is carried by the customer. By return of goods, only the merchandise value will be reimbursed. Invoiced shipping costs cannot be reimbursed.
7.3 Special customized wishes and used goods are excluded from return.
7.4 All combined products (e.g. " We are different") may only be returned complete in the original packing.
7.5 Returns are only possible via channels( Internet, retailers, shop) used for the original purchase.
7.6 Returns are only possible on production of sales receipt.
§8. Data Protection
8.1 All confidential data sent to us will be protected. Your data will not be passed on to third parties.
§9. Copyright
9.1 All our instructions, photos and texts are subject to copyright and may not be copied.
§10. Severability
10.1 Should one or more paragraphs (or part of a paragraph) of the General Terms and Conditions be invalid for any reason, the rest of the General Terms and Conditions shall remain unaffected and valid.
§11. Liability
11.1 According to legal provision Rohrspatz & Wollmeise is liable without restriction for damages to life and limb or health, which arise out of wilful or negligent breach of duty and for other damages which arise out of wilful or negligent breach of duty or malice on the part of Rohrspatz & Wollmeise. Over and above that, Rohrspatz & Wollmeise is liable without restriction for damages which are covered by the liability of conclusively legal regulations, such as the product liability law.
11.2 Rohrspatz & Wollmeise is liable for damages caused by slight negligence, in so far as the damage concerns such contractual obligations of particular importance in compliance with the fulfilment of the contract (cardinal obligations). The liability is limited to foreseeable, exemplary and direct mean damages.
11.3 Rohrspatz & Wollmeise is not liable to businesses in the event of minor damages caused by negligence; in such cases the liability towards customers is limited to foreseeable, exemplary and direct mean damages.
11.4 Any further liability is excluded without consideration of the legal nature of the claim.
11.5 Some people may experience allergic reactions on contact with wool. In such cases we cannot be held liable.
§12. Place of Jurisdiction is 85276 Pfaffenhofen, Germany
12.1 We assume that our General Terms and Conditions have been accepted as binding.
