The here mentioned general Terms and Conditions (T&C) are the AGBH which are the general terms and conditions like used normally in all austrian hotel industry. The first part are the terms and conditions in the context of our hotelvoucher-mangemant, then the general and some additional special general terms and conditions for Hotel Alpenrose. They are stronger than all other general terms and conditions mentioned on internetportals and stronger than the AGBH , which you find in the second part. Both Terms and Conditions, ours and those of the AGBH, are valid.

"Crowdfunding Anteil" in Form von Hotelgutscheinen fuer Hotel Alpenrose in Ischgl/"Crowdfunding share" in form of hotelvouchers for hotel Alpenrose in Ischgl.

Machen Sie mit und erhalten Sie dafuer 50 Prozent Rabatt innerhalb von 5 Jahren. Den ersten Fuenftel-Jahreseurobetrag von 400,- Euro, koenen Sie sich gleich beim jetzt reservierten Urlaub abziehen, aber nie als Anzahlung, sondern immer bei der Endabrechnung beziehungsweise Endzahlung. Wesentlich ist, dass Sie mit einem Hotelgutschein die Neutralitaet der Schweiz staerken, und Sie "parken" Ihr Hotelgutscheinkapital in der Schweiz, waehrend der Laufzeit, wofuer Sie diesen Rabatt erhalten, und erhalten zudem dafuer einen mit Uebernachtung mit Fruehstueck gedeckten Euro-Hotelgutschein fuer das Hotel Alpenrose in Ischgl./Join in and geht 50 % discount within 5 years. The first fifth-yeareuroamount of 400,- euro, you can discount already for the now reservated holiday, but never as deposit, but always with the endpayment. If you want, then next year after 365 days, you can discount again 400,- euro, and you have consumed, in the case that nothing happens, nearly all your invested capital of 1000,-, but you then have still more than 1000,- euro restvalue, which can be transfered also to another person minus a working-fee. The company secSOS-GmbH is in possession of the same family like the Salner Hotel Alpenrose GmbH. Fundamental for this is, that your hotelvoucher strenghten the neutrality of switzerland and you "park" your hotelvouchercapital in Switherland, during the time-run of the hotelvoucher, and you get for this this discount included,, also with bed and breakfast value covered euro-hotelvoucher for the hotel Alpenrose in Ischgl.

Jedes Jahr ist ein Fuenftel konsumierbar und aufsparbar, waehrend der Laufzeit. Es ist also nicht moeglich Fuenfteljahresbetraege zukuenftiger Jahre schon in der "Gegenwart" zu konsumieren. Es ist aber moeglich nicht konsumierte Fuenfteljahresbetraege vergangener Jahre aufzusparen und dann zusammen in der "Gegenwart" zu konsumieren. Aber am Ende der Laufzeit verfallen nicht konsumierte Jahresbetraege ersatzlos. Sie koennen die Fuenftel-Jahresbetraege nie als Anzahlung verwenden, sondern nur bei der Endzahlung zum spaeteren Zeitpunkt. In einigen Faellen wird es sich ergeben, dass Sie die aktuellen Eurobetraege dann bei der Endzahlung retourerhalten. Das ist notwendig, weil ansonsten unsere Anzahlung-Restzahlungs-Regeln fuer die Gutscheingaeste nicht gelten wuerden. Und unsere Regeln, die AGB vom Hotel Alpenrose Ischgl gelten fuer alle Gaest gleichermassen, auch fuer die Gutscheingaeste. Daher ist der Hotelgutschein nicht gueltig im Sinne einer Anzahlung. Weil ein wesentlicher Bestandteil der Gutscheinabwicklung die Tatsache ist, dass das "Gutscheinkapital" in der sichereren Schweiz aufbewahrt wird gilt im Zusammenhang mit der Gutscheinverwaltung das schweizer Recht und der Gerichtsstand ist Sankt Gallen in der Schweiz./Every year you can consume a fifth and you can collect and save them during the time-run. So it is not possible to consume the fifthyearamounts of future years in the present. But it is possible, to collect and save not consumed fifthyearamounts from the past, to consume them together in the "present". But at the end of the time-run expire the not consumed yearamounts, without substitution. You never can use the fifth-yearamounts as deposit, but only by the endpayment at the later point of time. In some cases you will get back then euroamounts by the endpayment. This is necessary, because otherwise our deposit-restpayment-rules would not be valid for the hotelvoucher-guests. And our rules, the terms and conditions of Hotel Alpenrose Ischgl have to be valid for all of our guests in the same way, also for our hotelvoucherguests. So the hotelvoucher is not valid in the sense of a deposit. A essential part of this hotelvoucherorganisation is the fact, that the "hotelvoucher-capital" is stored in the more secure Switzerland and therefore is for this hotelvoucherorganisation the swiss law valid and place of jurisdiction is Stankt Gallen in Switzerland.

Wird ein Fuenfteljahresbetrag oder Teilbetrag nochmal innerhalb des jeweiligen Jahres aufgeteilt und nicht auf einmal konsumiert, dann ist, bei jedem Aufteilen, eine extra Bearbeitungsgebuehr von 20% zu zahlen, vom gesamten in diesem Jahr genommenen Gutscheinteilbetrag./If you split a fifthyearamount or part-amount another time within the respective year and you do not consume at once, then you have to pay for each splitting 20% of the total in this year taken hotelvoucheramount. 

Die Laufzeit startet mit dem Kaufzeitpunkt./The time-run starts with the date of buying. .

Die HotelGutscheine sind auf eine andere Person uebertragbar. Dafuer bezahlen Sie aber 20 Prozent (Ihres eingesetzten Kapitals von 1000,-) als Arbeitsgebuehr. Wir werden dann Sie und den neuen Gutscheinbesitzer kontaktieren um Unterlagen, wie zum Beipsiel Reisepasskopie etc..., verlangen. Der Gutschein wird Ihnen gegeben in Form einer schriftlichen Bestaetigung und ist in unseren Systemen gespeichert. Wir haben keine Gutscheine in Form von der Druckerei gemachten Hochglanzgutscheinen./The hotelvouchers can be transfered into possession of another person, but you have to pay a workingfee of 20% (of your invested capital of 100,-). We will contact you and the new owner of the hotelvoucher then to get documents like passportcopy etc...The hotelvoucher you will get in the form of a written confirmation. We do not have hotelvouchers made of a print office in high-gloss-hotelvoucher. 

Die Gutscheine koennen Sie konsumieren zu den Oeffnungszeiten und Bedingungen des Hotel Alpenrose in Ischgl, wie diese auch fuer die anderen Gaeste ohne Hotelgutscheine gelten. Es gelten auch die AGB der Salner Hotel Alpenrose GmbH Bei Rechtsstreitigkeiten die sich aus dem Hotelgutschein ergeben ist  der Gerichtsstand Sankt Gallen in der Schweiz./The hotelvouchers you can consume during the opening times and conditions, like they are actually valid also for the other guests without hotelvouchers. For legal law cases which arise because of the hotelvoucher the place of juristiction is Sankt Gallen in Switzerland.

Sie koennen jeweils die Fuenftel-Jahres-Eurobetraege konsumieren und aufsparen wie Sie wollen, aber am Ende der Laufzeit von 5 Jahren verfallen die Gutscheine ersatzlos. Sie koennen die Gutscheine nie in Bargeld umtauschen. Die Gutscheine sind fuer, und wertgedeckt durch, Uebernachtung mit Fruehstueck im Hotel Alpenrose in Ischgl. Sie koennen zum Beispiel den ersten Fuenftel-Jahreseurobetrag bereits fuer den ersten Urlaub verwenden und abziehen lassen, aber jeweils immer erst bei der Endzahlung des jeweiligen Urlaubs. Den zweiten Fuenftel-Jahreseurobetrag koennen Sie dann im zweiten Jahr, nach 365 Tagen, konsumieren beziehungsweise abziehen./You can consume and save each of the fifth-year-euroamounts like you want, but at the end of the run-time the hotelvoucher expires without substitution. Es gilt und wird abgerechnet ab dem Kaufzeitpunkt des Gutscheines, immer der Eurobetrag. Das Risiko von eventueller Euro-Inflation und dass eventuell der Staat eine neue Waehrung einfuehrt, traegt und bezahlt der Gast und Konsument des Hotelgutscheines./It is always valid and basis of calculation, starting with the time when you buy the hotelvoucher, the euroamount. The risk of inflation and that the state eventually makes a new sort of money, this risk bears and carrys the guest and consumer of the hotelvoucher.

Sie erhalten einen Anteil an Hotellerie in Form von Hotelgutscheinen. Die secSOS-GmbH behaelt 20% der hier bezahlten 1000,- CHF als Arbeitsgebuehr ein. Diese Gebuehr zahlt aber das Hotel, nicht Sie. Ihr Kapital wird in der Schweiz angelegt, letztendlich in einem Drittel Gold, einem Drittel US-Dollar-Konto und einem Drittel schweizer Franken-Konto, damit die Hotels krisensicher veranlagt sind und weiter investieren koennen, und Ihr Hotelgutschein indirekt davon profitiert, weil er wertvoll bleibt. This means you can also, for example, consume only the fifth year the whole 2000 - Euro or after three years (2000, - Euro / 5 × 3 =) 1200,- Euro and the rest later, just as you like. Or give away the coupon or the rest of the coupon/voucher, and only above-mentioned workingfee is obtained, withdrawn from the rest of the value of the coupon. This is quite a lively investment, with a real value deposit, namely bed and breakfast in Hotel Alpernose Ischgl.

Without prepayment/deposit we do not have a reservation. Our offertext is very long, because it is at the same time our contracttext. The most important things are standing at the beginning.

You get an early-reservation-reduction of up to minus 20%, depending on how many rooms are still free for the wished time. This early reservation reduction is already included in the prices on this website. "Daily" roomcleaning is included in the price. Extra (exclusive) discount/reduction: In the case, that you want only 1 roomstartcleaning, you get a extra pricereduction of minus 10%, but also in this case, the daily towel-&wastedisposalservice and bedtextileusage is always included in the price, because of hygienic reasons. Not daily (special) cleaning costs extra 16%xprice(/person/night)xnumber of persons in the room. From Christmas to Easter our prices are only low for stays from saturday to saturday, 7 days/nights at once - other duration-stay-wishes are much more expensive. Prices are always per day/night and per person including only Bed and Breakfast(buffet). Description of categories please find below in the text. Every room is unique/different.

 

For a booking you have to make please a first deposit (prepayment) within normally 1 day of 40% or 100 % of the endsum. This offer is valid normally three days. If you can not manage this within the given time, you have please to inquire again. In the case of reservation more than 6 weeks befor arrivaldate: The rest of the payment (to reach 100% of the total amount) has to be on our bank account latest 6 weeks before arrival day, please. If the rest of the total amount (100%) is not on our bank account 6 weeks before your arrival day, we will take cancellation fees (please see the terms and conditions: AGBH below) and we do not have a reservation anymore and we will sell the rooms automatically to other tourists to keep the costs as low as possible. In the case of reservation less then 6 weeks before arrivaldate or stay over New Year´s Eve or in the case that you do not follow the saturday to saturday scheme: Then we always need 100% deposit. You can make the deposit with banktransfer or, as special wish, with credit card. - Deposit (prepayment) with banktransfer: 1. Please make a banktransfer of the deposit/prepayment (amount of persons multiplicated with deposit per person) with these bankdata: (cost-saving if you use swift and iban): Name of bank: Volksbank Landeck - Filiale Ischgl; Bank code number: 45850; contonumber: 00520032837; IBAN: AT094585000520032837; SWIFT (BIC): VBOEATWWLAN; 2. Please send us a copy of the banktransfer (e.g. online screenprint, with stamp or an internetprint) per mail (only jpg-file or pdf-file) or fax. Our fax number is: 0043(0)5444 5593. The copy of the banktransfer has to include following details please: name of person who did the inquiry, the period you book for, number of persons in sum, kind of room(s). If we don't have the copy of the bank transfer (e.g. online screenprint, bankconfirmation with stamp or an internetprint), you have no Booking/reservation. The offer is valid normally three days. If you can not manage it in the given time, you have to inquire again, please. 3. When we receive the copy of your bank transfer in time, you have a "prereservation". 4. As soon as the money arrives on our bank account (ca. 4 working days), you get the written and valid confirmation of us of your reservation. Prepayment (deposit) with credit card: We accept all common credit cards. 1. We need the name of the owner of the credit card please, the credit card number, the expiry date of the credit card, the three-digit check number on the back side of the creditcard and a written confirmation of the guest, that Hotel Alpenrose promptly may debit the amount of the preypayment (deposit) with the data of the credit card you gave us. At the same time, we need - if it is Possible, please a copy of the passport side with the signature of the owner, and also a copy of the credit card itself where we can see your signature. It´s very important that you give us your telephone number to call you please, if there are any problems with the procedure. Please send us all these datas with email (only jpg or pdf file) or fax. Our faxnumber is: 0043 (0) 5444 5593. The offer is valid normally three days. If you can not manage it in the given time, you have to inquire again, please. 2. You then will get immediately a receipt from the creditcardterminal so that you can see, that we debited from your credit card exactly the amount of the deposit. Meanwhile you have a "prereservation" in our hotel. 3. You'll get the written and valid booking confirmation from us as soon as the credit card company has transfered your deposit (prepayment) on the Alpenrose bank account. That normally takes up to four working-days and also depends, how fast our bank send us the bank receipt.

The cheapest possible skipass: (prices please see www.silvretta.at) - You get a guestcard from us. With this card you get the most reduced VIPskipass at the cable railway station. This is the same skipass price which you get from the other hotels when they offer you a package. Prices for example the 6-days-Skipass you can see on www.silvretta.at.

Room-categories: Category A: (about 5 to 10% more expensive than category B) toilet, wash bassin and shower in one extra cabin in the room and/or bigger room and/or new renovated room Category A-big: (20 % more expensive than category B) The doublebedrooms Category A-big have more square meters than the normal category A rooms. These rooms are the best in our house. In the room are comfortable seatings, table and chairs. These rooms have always balcony. Category B: in the room is an extra closeable toilet-cabin (advantage), an extra shower with sliding door and an extra wash basin, which is free visible in the room (disadvantage) Category H: (3% to 15% less in price than category B) wash basin is in the room, shower and/or toilet is on the floor, whereas nobody or maximum 1 other room uses these facilities as well. Our doublebeds (e.g. in doublebedrooms) exist of two pillows, two separate covers two separate matresses, but cannot be divided. In morebedrooms (rooms with 3 and more beds in it, you get a reduction of 10 % per person per day but only if there is taken no kind of childrenreduction in this room. Rooms of category H get a reduction of 3 % until 15%. If you use a room with 3 or more beds only with 2 persons, the two persons have to pay plus 20 % per day per person. Single rooms pay plus 20 % per day. All this is already included in the price above and cannot be taken extra. Only children until 8 years get a redution of 50% as a third and or fourth person in the double room or in a shared room/morebedroom, and only if minimum two persons have to pay full.

Please help us, to save parking-space. We have one parking place for a doublebedroom, or for a morebedroom (shared room) or for singletraveler in a singlebedroom. If you come with more cars you have to pay ca. Euro 10,- per day in a public parking garage (3 minutes walk away from our hotel). When you arrive with less or without car you get 5 % reduction per day per person, only in highseasontimes (weekends and generally in the time from christmas until erster) and only if you inform us per writing before(!) the reservation.

We expect normally that the guests arrive at 2 o'clock p.m. or later and depart until 10 o'clock a.m. If it's not possible for you, please speak/write with us before.

We offer our guests cheap Internet access (pay-WLAN) in all rooms. 

We have a safe for your valuables and money at the reception. Please do not leave money and valuables in the rooms, we cannot give warranty for that. 

We only have Bed and Breakfast(buffet). In our breakfastroom is less space in the case that the Hotel is full, so probably you do not have a table on your own and you have to share it with other pople. This is not only a disadvantage - you find more often friends this way. Without all meals our prices are minus 15%. We do have these reductions only when you write to us before/by the reservation. We do NOT have any meals special for allergic persons or persons who want diet, because of responsibility/insurance. There is only our menu possible (please see our homepage-/offertext). If necessary, because of allergy, please take your medicaments (antihistamine, cortisone...) with you.

We do not have Lunchpackages instead of the breakfast. Breakfast is only at our breakfasttimes.

We do not have a public-room/commonroom/loungeroom.

Public swimmingpool costs about 2,- Euro (price from 2006) per person per day in the Silvrettacenter, which is about 4 minutes of walk away from our house. Please pay at same time and place, when paying the skipass. With this skkpass you pay for sauna only about 5,5 Euro (priec from 2006) per day. The sauna is public and mixed and is also in Silvrettacenter. The price for Solarium and Massage is depending on time consume and can be paid there extra.

For our contract we have the rules and laws/terms and conditions of the "Allgemeinen Geschäftbedingungen für die Hotellerie in Oesterreich" and our stronger special AGB (special terms and conditions): Court of juristiction is Landeck/Tirol. Cancellation until 3 month before arrivaldate has already a cancellationfee of 40%. Cancellation until 1 month before arrivaldate: cancellation fee is 70 % of the endsum, cancellation until 1 week before arrivaldate: cancellation fee is 90% of the endsum, and a cancellation in the last week before arrivaldate/no-show: cancellation fee is 100% of the endsum. This all is also in case, that we can sell the room to other tourists, because the work to find new tourists is very very much and therefore expensive. If you "change something with the roomsreservation, you have to pay arrangement fee for us (ca. 18% of endsum or about Euro 80,- (pricebase 2006) per working hour).  In case of an macroeconomical inflation/banksystemcrash in the time between reservation and consumption of the holiday, this will be paid (eventually in parts) by the guest/tourist in advance. Buying-power security rules: The value what has to get Hotel Alpenrose in exchange for the service/accomodation has to be assured/guaranteed so therefore the following rules are valid. For the calculation of the buying-power the Verbraucherpreisindex (=consumerpriceindex) of Statistik Austria which is monthly published/released from that year (month) in which the guest reservate the holiday and make the first deposit (=basismonth/starting month) or, if this index will not exist in the future anymore, another compareable index. As reference base (endingmonth) for the calculation is (in sum) that index-rate of the month/year valid, in which the guest consumed the holiday and/or depart (last day of stay). All changing rates have to be calculated on one decimal place. Value-conservation/Buying-power payments have to be made ongoing, to point of times, which Hotel Alpenrose is deciding, otherwise this would be a cancellation from the side of the guest and the cancellation rules like here described in the AGB (Terms and Conditions) are valid. 

We recommend that you make a travelinsurance, so that you do not have to pay for example, the hole sum of your booking (minus meals) if somebody is getting sick one month before arrivaldate.

Please note, that we have different prices because of the different seasontimes. Middle of February till middle of March the price is from 75,- to ca. 120,- Euro. These prices are only valid if you stay 7 days minimum. So when you don´t stay from Saturday to Saturday 7 days, then the price is higher. For example when you only stay 3 days, it´s much more expensive. First here are/were mentioned our special terms and conditions which are stronger than the below mentioned AGBH (=terms and conditions for the hotel industry).

 

For our contracts ar valid our own terms and conditions, which are stronger then the AGBH below, but also the AGBH is valid, but weaker. Below is the text of the AGBH like you can find it on the austrian economy organisation (Wirtschaftskammer Oesterreich). 2006 GENERAL TERMS AND CONDITIONS FOR THE HOTEL INDUSTRY (AGBH 2006) as of 15 November 2006

§ 1 Scope of application

1.1 These General Terms and Conditions for the Hotel Industry (hereinafter referred to as “AGBH 2006”) shall replace the previous ÖHVB [Austrian Hotel Contract Conditions] as amended on 23 September 1981.

1.2 The AGBH 2006 shall not exclude special agreements. The AGBH 2006 shall be subsidiary to agreements made on an individual basis.

§ 2 Definitions

2.1 Definitions: “Proprietor”: means an individual or entity that accommodates guests against remuneration. “Guest”:means an individual that uses accommodation. Usually the guest is also the Party. Guests also include those persons that are accommodated together with such Party (e.g. family members, friends etc.). “Party”:means a domestic or foreign individual or entity that enters into an Accommodation Agreement as a Guest or for a Guest. “Consumer” and “Entrepreneur”:these terms shall be construed as defined by the 1979 Consumer Protection Act (Konsumentenschutzgesetz) as amended. “Accommodation Agreement”:means the agreement made between the Proprietor and the Party, the contents of which are specified below.

§ 3 Execution of the agreement – Down payment

3.1 The Accommodation Agreement shall be deemed entered into upon the acceptance of the Party’s order by the Proprietor. Electronic declarations shall be deemed received when they can be collected by the party to which they are addressed under normal circumstances provided that they are received during the published business hours of the Proprietor.

3.2 The Proprietor shall be entitled to enter into the Accommodation Agreement under the condition that the Party makes a down payment. In such event, the Proprietor shall be obliged to inform the Party of the required down payment before accepting the written or oral order of the Party. If the Party agrees to the down payment (in writing or orally), the Accommodation Agreement shall be deemed entered into upon the receipt of the Party’s declaration of consent on the down payment by the Proprietor.

3.3 The Party shall be obliged to make the down payment no later than 7 days (receipt) before the accommodation. The costs for the financial transaction (e.g. remittance fee) shall be paid by the Party. Credit and debit cards shall be subject to the terms and conditions of the issuing company.

3.4 The down payment shall be deemed an instalment of the agreed remuneration.

§ 4 Start and end of accommodation

4.1 Unless the Proprietor offers any other time of occupancy, the Party shall be entitled to move into the rented rooms from 4.00 p.m. on the agreed date (“date of arrival”).

4.2 If a room is occupied for the first time before 6.00 a.m., the preceding night shall be deemed the first night of accommodation.

4.3 The rented rooms shall be vacated by the Party by 12.00 noon on the date of departure. The Proprietor shall be entitled to charge another day if the rented rooms are not vacated in time.

§ 5Rescission of the Accommodation Agreement – Cancellation fee Rescission by the Proprietor

5.1 If the Accommodation Agreement provides for a down payment and such down payment has not been made by the Party in time, the Proprietor may rescind the Accommodation Agreement without granting any grace period.

5.2 If the Guest fails to arrive by 6.00 p.m. on the agreed date of arrival, the Proprietor shall not be obliged to accommodate them unless a later time of arrival has been agreed upon.

5.3 If the Party has made a down payment (see 3.3), the rooms shall be deemed reserved until 12.00 noon on the day following the date of arrival at the latest. If a down payment to the amount of more than four days has been made, the obligation to accommodate the Guest shall end on 6.00 p.m. on the fourth day, the date of arrival being deemed the first day, unless the Guest informs the Proprietor of a later date of arrival.

5.4 Unless otherwise agreed upon, the Proprietor may rescind the Accommodation Agreement for objectively justified reasons by means of a unilateral declaration by 3 months before the agreed date of arrival of the Party. Rescission by the Party – Cancellation fee

5.5 Please note, that here are valid our more strict rules, like mentioned above in the text here. The rules here are the more soft rules of the Austrian Terms and Conditions of Hotel Industry (AGBH), who are replaced from our Terms and Conditions (AGB). The Party may rescind the Accommodation Agreement by means of a unilateral declaration by 3 months before the agreed date of arrival of the Guest without being liable to pay a cancellation fee.

5.6 Please note, that here are valid our more strict rules, like mentioned above in the text here. The rules here are the more soft rules of the Austrian Terms and Conditions of Hotel Industry (AGBH), who are replaced from our Terms and Conditions (AGB). Outside the period specified in § 5.5., the Party may only rescind the Accommodation Agreement by means of a unilateral declaration subject to the following cancellation fees: - 40% of the total agreed price by 1 month before the date of arrival; - 70% of the total agreed price by 1 week before the date of arrival; - 90% of the total agreed price within the last week preceding the date of arrival. Cancellation 3 months or more before the arrival date will cause no fee, 3 months to 1 month before 40%, 1 month to 1 week before 70%, in the last week 90% fee. Percentage of fee is always calculated from the endsum.

5.7 If the Party is prevented from arriving at the accommodating establishment on the date of arrival since this is impossible due to unforeseeable extraordinary events (e.g. extreme snowfall, floods etc.), the Party shall not be obliged to pay the agreed remuneration for the days of arrival.

5.8 The obligation to pay the remuneration for the booked stay shall revive as soon as the arrival becomes possible again provided that it becomes possible within three days.

§ 6 Provision of substitute accommodation

6.1 The Proprietor may provide the Party or the guests with adequate substitute accommodation (of the same quality) provided that this is reasonable for the Party, particularly if the difference is insignificant and objectively justified.

6.2 An objective justification shall, for example, be deemed given if the room(s) has (have) become unusable, guests that have already been accommodated prolong their stay, the establishment is overbooked or this becomes necessary due to other important operational activities.

6.3 Any extra expenses arising from such substitute accommodation shall be paid by the Proprietor.

§ 7 Rights of the Party

7.1 By entering into an Accommodation Agreement, the Party shall acquire the right to make normal use of the rented rooms and the facilities of the accommodating establishment that are usually accessible to the guests for use without any special conditions and of the usual service. The Party shall exercise their rights in accordance with any applicable hotel and/or guest regulations (rules of the house).

§ 8 Obligations of the Party

8.1 The Party shall be obliged to pay the agreed remuneration plus any extra amounts that have arisen from the use of special services by the Party and/or the accompanying guests plus any applicable VAT by the date of departure at the latest.

8.2 The Proprietor shall not be obliged to accept foreign currencies. If the Proprietor accepts foreign currencies, such shall be accepted at the current price if possible. If the Proprietor accepts foreign currencies or cashless means of payment, the Party shall pay any associated costs, e.g. for inquiries with credit card companies, telegrams etc.

8.3 The Party shall be liable towards the Proprietor for any damage caused by themselves or the Guest or any other persons that receive services of the Proprietor with the knowledge or in accordance with the intention of the Party.

§ 9 Rights of the Proprietor

9.1 If the Party refuses to pay or is in arrears with the agreed remuneration, the Proprietor shall be entitled to make use of the legal right of retention in accordance with § 970c of ABGB [Austrian Civil Code] and the legal right of lien in accordance with § 1101 of ABGB with respect to the items brought along by the Party or the Guest. Furthermore, the Proprietor shall be entitled to make use of this right of retention or lien in order to secure its claims under the Accommodation Agreement, particularly for catering, other expenses made for the Party and for any kind of damage claims.

9.2 If services are requested in the room of the Party or during unusual times of the day (after 8.00 p.m. and before 6.00 a.m.), the Proprietor shall be entitled to charge an extra remuneration. However, such extra remuneration shall be indicated on the price board for the room. The Proprietor may also refuse such services for operational reasons.

9.3 The Proprietor shall be entitled to issue invoices or interim invoices for its services at any time.

§ 10 Obligations of the Proprietor

10.1 The Proprietor shall be obliged to provide the agreed services to an extent that complies with its standards.

10.2 Extra services of the Proprietor that must be indicated accordingly since they are not included in the accommodation remuneration shall, by way of example, include: a)Extra accommodation services that may be invoiced separately, such as the provision of lounges, sauna, indoor and/or outdoor swimming pool, solarium, garages etc.; b)A reduced price shall be charged for the provision of additional beds or cribs.

§ 11 Liability of the Proprietor for damage to items of guests

11.1 The Proprietor shall be liable for the items brought along by the Party in accordance with §§ 970 ss of ABGB. The Proprietor shall only be liable if the items have been handed over to the Proprietor or the persons authorised by the Proprietor or deposited in a place assigned by such or intended for such purpose. Unless the Proprietor provides other evidence, the Proprietor shall be liable for its own fault or the fault of its vicarious agents and visitors. In accordance with § 970 sec. 1 of ABGB, the Proprietor shall only be liable up to the amount specified in the Austrian law on the liability of landlords and other entrepreneurs of 16 November 1921 (Bundesgesetz über die Haftung der Gastwirte und anderer Unternehmer) as amended. If the Party or the Guest fails to immediately comply with the Proprietor’s request to deposit their items in a special deposit, the Proprietor shall be released from any liability. The amount of any liability of the Proprietor shall be limited to a maximum of the sum insured under the third-party liability insurance of such Proprietor. Any fault of the Party or Guest shall be taken into account.

11.2 The Proprietor may not be held liable for slight negligence. If the Party is an Entrepreneur, the Proprietor may neither be held liable for gross negligence. In such event, the burden of proof to show the fault shall lie with the Party. No consequential or indirect damage and no loss of profit shall be reimbursed.

11.3 The Proprietor shall only be liable for valuables, money and securities up to an amount of currently €550.--. The Proprietor shall only be liable for any exceeding damage in the event it has accepted such items for deposition knowing their quality or in the event the damage has been caused by itself or its vicarious agents. The limitation of liability in accordance with 12.1 and 12.2 shall apply accordingly.

11.4 The Proprietor may refuse to deposit valuables, money and securities if the items are significantly more valuable than those usually handed over for deposition by the guests of the accommodating establishment.

11.5 In each event of deposition, liability shall be excluded if the Party and/or Guest fails to immediately notify the Proprietor of the occurred damage. Furthermore, such claims shall be asserted in court within three years from their knowledge or possible knowledge to the Party and/or Guest; otherwise, the right shall become extinct.

§ 12 Limitations of liability

12.1 If the Party is a Consumer, the Proprietor may not be held liable for slight negligence, except for bodily injury.

12.2 If the Party is an Entrepreneur, the Proprietor may not be held liable for slight or gross negligence. In such event, the burden of proof to show the fault shall lie with the Party. No consequential, non-material or indirect damage and no loss of profit shall be reimbursed. The damage to be reimbursed shall at any case be limited to the amount of the damage incurred because the Party has relied on the validity of the agreement (Vertrauensinteresse).

§ 13 Animals

13.1 Animals may only be brought to the accommodating establishment with the prior consent of the Proprietor and against extra remuneration.

13.2 The Party bringing along an animal shall be obliged to properly keep and/or supervise such animal during their stay or to have it kept and/or supervised by a qualified third party at their own expense.

13.3 The Party and/or Guest bringing along an animal shall have an according animal liability insurance and/or personal liability insurance that covers any potential damage caused by animals. Evidence of such insurance shall be provided to the Proprietor upon request.

13.4 The Party and/or their insurance company shall be jointly and severally liable towards the Proprietor for any damage caused by the animals brought along. Such damage shall particularly also include any compensation to be paid by the Proprietor to third parties.

13.5 Animals shall not be permitted to enter the lounges, saloons, restaurants and wellness zones.

§ 14 Prolongation of the accommodation

14.1 The Party may not claim for a prolongation of their stay. If the Party informs the Proprietor in time that they intend to prolong their stay, the Proprietor may consent to a renewal of the Accommodation Agreement. However, the Proprietor shall not be obliged to do so.

14.2 If the Party is prevented from leaving the accommodating establishment on the date of departure since all ways of travel are blocked or unusable due to unforeseeable extraordinary events (e.g. extreme snowfall, floods etc.), the Accommodation Agreement shall automatically be renewed for the duration of such prevention from departure. The remuneration to be paid for this period may only be reduced if the Party is unable to fully use the offered services of the accommodating establishment due to the extraordinary weather conditions. The Proprietor shall be entitled to charge as a minimum the remuneration corresponding to the price usually charged in the low season.

§ 15Termination of the Accommodation Agreement – Early cancellation

15.1 If the Accommodation Agreement has been made for a definite term, it shall end upon the expiry of such term.

15.2 If the Party leaves prematurely, the Proprietor shall be entitled to charge the total agreed remuneration. The Proprietor shall deduct anything saved due to the failure to use its scope of services or maintained by letting the booked rooms to other guests. Such savings shall only be deemed to exist if the capacities of the accommodating establishment are fully used upon the Guest’s failure to use the booked rooms and the room can be let to other guests due to the cancellation by the Party. The burden of proof to show that savings have been made shall lie with the Party.

15.3 Upon the death of a Guest, the Agreement with the Proprietor shall become extinct.

15.4 If the Accommodation Agreement has been made for an indefinite term, the Parties may terminate the Agreement by 10.00 a.m. of the third day preceding the intended end of the Agreement.

15.5 The Proprietor shall be entitled to terminate the Accommodation Agreement with immediate effect for important reasons, particularly if the Party and/or the Guest                                                                                                      a)makes significantly adverse use of the rooms or makes their stay intolerable for the other guests, the owner, its vicarious agents or the third parties staying at the accommodating establishment due to ruthless, offensive or otherwise highly improper conduct or commits an act against property, morality or physical safety towards these persons that is subject to penalty;                                                                                                                                                   b)suffers of a contagious disease or a disease the duration of which exceeds the term of accommodation or otherwise is in need of care; c)fails to settle the presented invoices when they become payable within a reasonably set period (3 days).

15.6 If the performance of the Agreement becomes impossible due to circumstances to be deemed events of force majeure (e.g. acts of God, strike, lockout, official orders etc.), the Proprietor may terminate the Accommodation Agreement at any time without giving prior notice unless the Agreement is already deemed terminated under the law or the Proprietor is released of its obligation to accommodate the Party. Any claims for damages etc. by the Party shall be excluded. We use your personal datas only in our recervation-process and we do not give them other persons. The privat policy law of the European Union and Austria is valid. We keep your datas within our Hotel. Nobody outside will find them. Only the paymentsystems used with the reservation need some of your minimum datas. Your confidence is very important for us. Therefore we want to offer you an answer to alle questions you have.
